Skop Kelakuan Buruk Dalam Kod Kelakuan Profesional 1987: Satu Analisis Menurut Etika Perubatan Islam

Abstract

The Code of Professional Conduct 1987 is designed to promote medical professionalism and good medical practice among medical practitioner. In spite of the measures taken, every year the Malaysian Medical Council received numerous complaints regarding unethical behavior of the medical practitioners. In Malaysia, the medical practitioner is monitored by the Malaysian Medical Council. Since, among those found guilty of infamous conduct were Muslims, this article seeks to determine to what extent the Code of Professional Conduct 1987 is consistent with the Islamic medical ethics. It is found that the three categories of infamous conduct namely ‘neglect or disregard of professional responsibility, abuse of privileges and skill and conduct derogatory to the reputation of the medical profession’ are in line with the Islamic medical ethics. However, it appears that the existing Code is not sufficient to overcome the problem of professional misconduct among the medical practitioner. For that reason, new provisions that are contained in the Islamic medical ethics may be incorporated to improve the scope of infamous conduct such as specific provisions on consent, confidentiality and chaperone. Those new provisions will address lacunas to the Code in solving problem of professional misconduct among the medical practitioner. Therefore, by having those provisions would assist the Malaysian Medical Council in preserving the dignity of the medical profession.
